An Enforcement Notice has been issued relating to the unauthorised retention of the above

Roundhouse and I now serve on you copies of the notice in view of your interest in the land.

Copies are also being served on others who may have an interest in the land.

 

Unless an appeal is made to the Planning Inspectorate, as described below, the notice will take effect on the 15 September 2002 and you must then ensure that the required steps for which you may be held responsible are taken within the period specified in the notice. If you wish to appeal against the notice you should first read the annex to the notice and also the enclosed booklet entitled "Making your Enforcement Appeal". Your attention is particularly drawn to pages 25 - 37 of the booklet which sets out the relevant sections of the Act relating to powers to issue Enforcement Notices and your right of Appeal. You, or your agent, should then complete the enclosed appeal form and send one copy with the extra copy of the enclosed Enforcement Notice to the Planning Inspectorate at the address given in the Annex to the Notice. A copy of the appeal form must also be forwarded to me at the address given at the head of this letter and the other copy is for your retention (see Annex).

 

In some cases a fee will be payaNe for the deemed application that arises but the Planning

Inspectorate will notify you of the appropriate fee, if required, after the appeal has been lodged.

Your appeal must be received by The Planning Inspectorate before the 15 September 2002 when

the Notice takes effect.

1.THIS NOTICE is issued by the Authority because it appears to them that there has been a breach of planning control, within paragraph (a) of Section 1 71A(1) of the above Act, at the land described below. They consider that it is expedient to issue this notice, having regard to the provisions of the development plan and to other material planning considerations. The Annex at the end of the Notice and the enclosures to which it refers contain important additional information.

 

2.         THE LAND TO WHICH THIS NOTICE RELATES

 

Land at OS Parcel 7656 at Brithdir Mawr, Cilgwyn Road, Newport shown edged red on the attached plan

 

3.         THE MATTERS WHICH APPEAR TO CONSTITUTE THE BREACH OF PLANNING CONTROL ALLEGED

 

Without planning permission the retention of a turfed roof roundhouse for human habitation purposes in the approximate position marked with a cross on the attached plan

 

4.            REASONS FOR ISSUING THIS NOTICE

The temporary planning permission relating to this building expired on 25 July 2002. It appears to the Authority therefore, that the above breach of planning control has occurred within the last four years. The building contains within it the usual domestic facilities of a dwelling house:

cooker; sink; living and sleeping accommodation. Despite its unusual design it appears to the Authority to be a dwellinghouse.

 

The site is located in the open countryside within a National Park where, with certain exceptions which do not apply in this case, there is a strong presumption against any development. The development is contrary to development plan policies and national guidance. The Authority do

1È_ _       not consider that planning permission should be granted because planning conditions could not overcome these objections to the development.

 

5.         WHAT YOU ARE REQUIRED TO DO

 

Demolish the dwellinghouse, remove all materials arising from the site except for turf and topsoil, restore the site of the dwellinghouse to its condition prior to the erection of the building by replacing all such topsoil and turf thereon, and plant the restored area with vegetation similar to that existing elsewhere on the site.

 

6.         TIME FOR COMPLIANCE

 

6 calendar months after this notice takes effect.

 

7.         WHEN THIS NOTICE TAKES EFFECT

 

This Notice takes effect on 15 September 2002 unless an appeal is made against it beforehand.

You can appeal against this Notice, but any appeal must be received, or posted in time to be received, by The Planning Inspectorate, Crown Buildings, Cathays Park, Cardiff, CF1 3NQ, before 15 September 2002 The enclosed booklet "Making your enforcement appeal" sets out your rights. Read it carefully. You may use the enclosed appeal forms if you decide to appeal. One is for you to send to The Planning Inspectorate, please also send a copy to me at the address given above and the other is for you to keep for your own records. You should also send The Planning Inspecto rate the spare copy of this Enforcement Notice which is enclosed.

 

 

WHAT HAPPENS IF YOU DO NOT APPEAL

 

 

If you do not appeal against this Enforcement Notice, it will take effect on 15 September 2002 and you must then ensure that the required steps for complying with it, for which you may be held responsible, are taken within the period specified in paragraph 6 of the Notice. Failure to comply with an Enforcement Notice which has taken effect can result in prosecution and/or remedial action by the Authority.
